MOTION TO CONVERT CHAPTER 13 TO CHAPTER 7, 11 or 12/SUA SPONTE ORDER
 
Overview:
 
Under 11 U.S.C. Section 1307(a) the debtor may convert a case under this chapter to a case under chapter 7.
 
Under 11 U.S.C. Section 1307(c) on request of a party in interest, and after notice and hearing, the court may convert a case under this chapter to a case under chapter 7, 11 or 12 for cause.
 
Under 11 U.S.C. Section 1307(d) on request of a party in interest, at any time before the confirmation of a plan under section 1325, and after notice and hearing, the court may convert a case under this chapter to a case under chapter 11 or 12.
 
Under 11 U.S.C. Section 1307(f) the court may not convert a case under this chapter to a case under chapter 7, 11 or 12 if the debtor is a farmer, unless the debtor requests such a conversion.
 
This filing should be accompanied by the Motion and Proposed Order (unless filed as an Election to Convert).  When required by Local Bankruptcy Rule 9013-3, a Certificate of Service must also be filed.

A conversion will not be held up if the fee is due.
 
The Judge may convert a case without a motion or election being filed. Filing fee is not required.
