Convert Ch. 12 to Ch. 7/Sua Sponte Order

MOTION TO CONVERT CHAPTER 12 TO CHAPTER 7/SUA SPONTE ORDER
 
Overview:
 
Under 11 U.S.C. Section 1208(a) the debtor may convert a case under this chapter to a case under chapter 7 (fee due upon conversion).
 
Under 11 U.S.C. Section 1208(d) on request of a party in interest, and after notice and hearing, the court may convert a case under this chapter to a case under chapter 7 upon showing that the debtor has committed fraud in connection with the case.
 
The filing should be accompanied by the Motion and a Proposed Order.  For order format, please see Proposed Orders
 
A conversion will not be held up if the fee is due.
 
The Judge may convert a case without motion or election being filed. Filing fee not required.
