OF PROPOSED AMENDMENTS TO THE LOCAL BANKRUPTCY
RULES AND FORMS FOR THE U.S. BANKRUPTCY COURT
FOR THE MIDDLE DISTRICT OF PENNSYLVANIA TO
BECOME EFFECTIVE DECEMBER 1, 2018

The U.S. Bankruptcy Court for the Middle District of Pennsylvania proposes to amend certain of its Local Bankruptcy Rules and Forms.  The changes have been provisionally approved by the Bankruptcy Judges.  The Court hereby offers public notice of the proposed amendments and seeks public comment.  The amendments to the Local Rules will become effective on December 1, 2018.

Briefly, the Rule amendments include: (1) amending LBR 2014-1 to be consistent with Fed.R.Bankr.P 9025 and Fed.R.Civ.P 65.1; (2) amending the comments of LBR 2016-2; (3) amending LBR 3007.1-1 to place service requirements imposed by Fed.R.Bankr.P.3007(a)(2)(A) on Non-ECF files rather than the clerk's office; (4) amending LBR 5005-1 to eliminate redundancy with new Fed.R.Bankr.P. 5005; (5) amending LBR 9010-1 to no longer require law firms to submit ongoing case lists following the departure of an attorney; (6) amending LBRs 9013-2 to encompass in the amendments to FRCP 5(D)(1)(B). 

Local Bankruptcy Form 3015-1 (Model Plan) was also amended.  These amendments were made so the Model Plan would better track with §§1325 and 1322 of the Code.  There were also several formatting changes.

The proposed amendments reflect the input of members of the creditors' and debtors' bar, as well as the Chapter 13 Trustee, and the Clerk's Office.

Comments on the proposed amendments may be submitted online, by email to PAMB_Local_Rules@pamb.uscourts.gov, or by U.S. Mail to the Honorable Henry W. Van Eck, Ronald Reagan Federal Building, 228 Walnut Street, Harrisburg, Pennsylvania, 17101.  Comments must be submitted no later than November 5, 2018.
