MOTION FOR DETERMINATION OF SECURED STATUS/VALUATION OF SECURITY
 
Overview:
 

A motion for determination of secured status is filed for the purpose of determining the value of secured property as it relates to plan confirmation. Most motions for valuation are filed as part of the Chapter 13 plan. However, secured creditors in a Chapter 13, Chapter 11, and a Chapter 7 case may also file this motion separately when the value of property is in dispute.

This filing should be accompanied by the Motion, Notice of Motion, and Proposed Order.  When required by Local Bankruptcy Rule 9013-3, a Certificate of Service must also be filed.
