Automatic Stay (Extend, Impose or Reimpose)

MOTION TO EXTEND OR IMPOSE THE AUTOMATIC STAY
 
Overview:
 

A motion to extend the automatic stay is filed when the stay, in effect, will expire within 30 days U.S.C. Section 362(c­)(3).

A motion to impose the automatic stay is filed when there is no stay in effect, due to prior filings U.S.C. Section 362(c)(4). Restricts on the duration of the automatic stay for repeat filers applies to Chapter 7, 11 and 13 individual cases. 

This filing should be accompanied by the Motion, Certificate of Service and Proposed Order.
