MOTION TO CONVERT CHAPTER 12 TO CHAPTER 7/SUA SPONTE ORDER
 
Overview:
 
Under 11 U.S.C. Section 1208(a) the debtor may convert a case under this chapter to a case under chapter 7 (fee due upon conversion).
 
Under 11 U.S.C. Section 1208(d) on request of a party in interest, and after notice and hearing, the court may convert a case under this chapter to a case under chapter 7 upon showing that the debtor has committed fraud in connection with the case.
 
This filing should be accompanied by the Motion and Proposed Order.  When required by Local Bankruptcy Rule 9013-3, a Certificate of Service must also be filed.

A conversion will not be held up if the fee is due.
 
The Judge may convert a case without motion or election being filed. Filing fee not required.
