CLAIMS
WITHDRAWAL OF CLAIM

Overview:

A creditor may withdraw a claim as of right by filing a notice of withdrawal unless the creditor has filed a proof of claim that has been objected to, a complaint is filed against that creditor in an adversary proceeding, or the creditor has accepted or rejected the plan or otherwise has participated significantly in the case.  A request to withdraw a claim must state whether an objection was filed, a complaint against the claimant was filed, and whether the claimant has accepted or rejected the plan or otherwise participated significantly in the case.  If so, the creditor may not withdraw the claim except on order of the court after notice and hearing.
