Automatic Stay (Extend, Impose or Reimpose)

MOTION TO EXTEND OR IMPOSE THE AUTOMATIC STAY
 
Overview:
 

A motion to extend the automatic stay is filed when the stay will expire within 30 days pursuant to U.S.C. Section 362(c­)(3).

A motion to impose the automatic stay is filed when there is no stay in effect due to prior filings.  Restricts the duration of the automatic stay for individual or joint debtors who have filed 2 or more prior cases.  Refer to U.S.C. Section 362(c)(4) for specific guidance.

A motion to reimpose the automatic stay is a request to reinstate the automatic stay after the order lifting the stay has been entered.

This filing should be accompanied by the Motion and Proposed Order.  When required by Local Bankruptcy Rule 9013-3, a Certificate of Service must also be filed.
