Overview: 
A motion for dismissal under section 521(i)(2) can be filed by the UST or party in interest and must be heard within (5) five business days. The UST generally files these upon examination of payment advices that they determine invalid or when the debtor(s) received income from another source sixty (60) days prior to filing their case.   This filing should be accompanied by the Motion and Proposed Order.  

When required by Local Bankruptcy Rule 9013-3, a Certificate of Service must also be filed.
